Will I be blamed just because I was on a motorcycle?

The other side will try. Insurers routinely open by suggesting the rider was speeding, lane splitting, or riding recklessly, even with nothing in the crash report to support it.

It is an argument, not a fact, and it is answered with evidence: the physical scene, independent witnesses, and where the damage actually appears on both vehicles.

Does not wearing a helmet hurt my claim in Texas?

Texas allows riders 21 and over to ride without a helmet if they meet the training or insurance requirements, so riding unhelmeted is not automatically negligence.

It can still come up if the injuries are to the head. It has no bearing at all on a broken leg or a shoulder injury, and it does not affect who caused the crash.

The driver says they never saw me. Does that help or hurt?

It generally helps you. A driver has a duty to keep a proper lookout, and "I didn't see the motorcycle" is much closer to an admission of failing that duty than it is to a defense.

The most common version of this is a left turn across an oncoming rider, and it is one of the more provable fact patterns in motorcycle litigation.

What compensation is available for road rash and scarring?

Beyond the medical costs of treatment and any reconstructive work, Texas recognizes disfigurement and physical impairment as separate categories of damages from pain and mental anguish.

Permanent visible scarring is valued on its own. Photographs taken during healing, not just after, matter here.

My bike was destroyed. Is that covered?

Property damage runs on a separate track from the injury claim and usually resolves faster. Custom parts and aftermarket work are frequently undervalued in the first offer, so keep receipts and pre-crash photos.

What if the driver who hit me was uninsured?

Your own uninsured/underinsured motorist coverage steps in. Given how often riders are struck by drivers carrying state minimum limits, UM/UIM is frequently the largest source of recovery in a motorcycle case — and it is the first thing we look for.

What does it cost to hire LAWBOSS?

How long do I have to file a claim in Texas?

In most cases, two years from the date of the injury. Miss that window and the court will almost always dismiss the case regardless of its merits.

The exceptions matter in both directions: the clock is paused for a child until their 18th birthday, while a claim against a city, county, or state agency requires written notice far sooner — six months under state law, and as little as 45 or 90 days under some city charters. Because the deadline depends on who is at fault, it is worth confirming early.

What if I was partly at fault?

You can still recover. Texas uses proportionate responsibility: as long as you are 50% or less at fault, you collect damages reduced by your share of the blame. At 51% you recover nothing.

That threshold is exactly why adjusters work so hard to pin blame on the injured person early. Fault is argued, not decided at the scene.
